Terms & Conditions
1. Order processing:
Commissions: When ordering a commisison, after the 25% initial payment you will receive a notification of the estimated completion date, which will be no more than 2 weeks. Once the art piece is completed and 100% satisfaction is reached, the remaining 75% payment will be requested and once fullfiled, shipping arrangements will de made and the delivery estimate time would be between 3 to 9 business depending on destination
Original artworks: Will be processed & dispatched within 2-5 working days once payment has been received in full. Not available until January 2025
Prints: Will be processed & dispatched within 2-5 working days. Not available until January 2025
2. Packaging:
Comissioned pet portraits are made on a fine Hahnemhule Velour paper mounted hardboard or Clairfontaine Pastelmat mounted harwood so transit and manipulation of the piece when framed beomes easier and safer, will be protected with glassine paper and wraped in protective bubble film or envelope to ensure a safe transit, It will be accompanied by certificate of authenticity and care and framing recomendations
Prints are packaged flat or rolled in a tube depending on size. Will allways be protected with glassine paper, placed in either an archival plastic sleeve or wrapped in acid-free tissue paper and inside a shipping tube. I aim to make packaging as recyclable & eco friendly as possible while still protecting your artwork during transit.
3. Payment:
Payments are securely made through o Stripe or PayPal. Stripe processes all credit / debit cards, Apple Pay, Google Pay & Klarna payment options. PayPal processes all of PayPal payment options.
Commissions: Once we have selected the reference photo. I will send you the 1st custom link to pay for the initial 25% cost of the portrait via email. Upon completion & once you have approved of the final result, I will send you the 2nd custom link to pay for the remaining 75% cost of the portrait. No additional payment is required for shipping
4. Shipping:
All orders are shipped from Spain. Shipping costs are included for international priotity shipping
You will receive tracking info upon dispatch via the email entered at checkout. Shipping is unavailable for PO boxes, a home address & availability to sign for the package is required.
5. Address & delivery:
Your mobile phone number may be required during checkout, as the shipping company may need it for recipients.
All items will be shipped to the address you provide at the order form. Please ensure you double-check the delivery address before completing your purchase. If you find any errors, please email us as soon as possible at josiederutte.art@gmail.com. Once items have been shipped to the incorrect address, I cannot change the address or cancel the delivery.
If your items arrive damaged or if you haven’t received them within two weeks after the estimated delivery date, please contact us immediately at josiederutte.art@gmail.com.
6. Framing:
I currently do not offer any framing options, all artworks & prints will arrived unframed but mounted on a hardboard for easy handling.
7. Returns & refunds:
Do to the personalized nature of commisioned artwork refunds are not applicable. In the unfortunate and unlikely case of a damaged product upon delivery, please contact us at josiederutte.art@gmail.com immediately within 48hrs of reciept so I can replace it as soon as possible.
In the event of a package being returned to us due to an incorrect shipping address entered, I will be happy to resend the artwork, with the buyer covering the cost of re-shipment.
Commission Payments:
First payment: If the first payment has been made and the outline sketch has started, no refund will apply due to material usage and time spent.
Second & final payment: This is to be paid upon completion of the artwork once it’s to your satisfaction. Your completed portrait will be shipped to you once the remaining 75% amount has been fully paid.
Originals & prints: [Not available until January 2025]
Refund request: Customer satisfaction is very important to us. If you are not satisfied with your purchase, a full refund (not including shipping costs) will be accepted when notified within 7 days since delivery. The refund will be honoured once the item has been successfully shipped back and received in its original 100% undamaged condition within 30 days of the return request.
It is the buyers responsibility to safely re-package the product the same way it was received for a damage-free return transit. To facilitate this, it’s important that you keep all shipping materials in good condition until you are 100% satisfied with your purchase. The cost of a return shipment is at the buyer’s expense. It is also the buyers responsibility to choose a suitable delivery service that insures them for the value of the products.
Accepting delivery: Buyers are responsible for tracking their shipment via the provided tracking information sent by email & ensuring availability to accept delivery. If a product reaches its destination but is not received or becomes lost after an attempted delivery, it is the buyers responsibility to directly contact the shipping company for resolution or re-delivery. A refund (excluding shipping costs) can only be issued if the artwork/print is successfully returned to us undamaged within 30 days of the initial delivery attempt.
Lost in transit: If a product fails to reach its destination due to being lost by the shipping company, I will happily offer a full refund or replacement when notified within 90 days since dispatch. Please make sure to track your package and inform us promptly of any issues.
8. Liabilities:
For purchases made from outside of Spain, any additional custom & tax fees that may occur when the package reaches your country are the responsibility of the buyer. These charges will vary depending on where you are located. I shall not be responsible for any of these fees.
9. Prices:
I reserve the right to determine the prices for any of my art products. Product prices are subject to change at any time. If you have already placed your deposit for a commission, an increase or decrease in price will not effect your original quoted cost.
10. Product perfection and expectations:
Due to variations in screen displays on devices, the colors of the artwork or prints may differ somewhat from what you see on your own device. Replica prints that accompany commissioned artworks may also appear slightly different from the original piece; however, every effort is made to minimize these differences and ensure the prints are as close to the original as possible.
For pastel artworks with a colored background, the portraits will have a blank border of a few millimeters on each side where the paper was taped to the drawing board. This border allows for easy handling of the painting without disturbing the pastel edges.
Realistic pet portraits are not Hyperrealistic works of art, although the attempt will allways be to make it as faithful as possible this is not an exact copy of a picture, therefore you will see the hand of the artist in the strokes and choice of colors to create the desired effect. The selection of paper is done depending on the picture chosen for the artwork and the individual characteristics like background and definition of the image. The two types of artist quality papers used are specifically designed for pastel painting and have different texture characteristics that I will use at my own criteria to achieve the best work possible.
Given the nature of original pastel artwork, there may be minor visible blemishes on the paper. I will take all necessary precautions to minimize these imperfections.
Actual paper sizes may vary slightly from the selected size on any side, as the paper is custom cut from larger sheets.
11. Changes to a completed commission:
Once the final touches to your commissioned artwork are finished, you will receive a photo to confirm your satisfaction. If you wish to have any small details changed, I will be happy to do this within reason. Due to the nature of the materials I may not be able to make significant changes once the artwork is completed.
12. Commission video recordings, social media reels and posts:
Commissions may be video recorded for marketing purposes and social media engagement. Although this is not guaranteed or offered as part of the commission process it is a possibility. Reels will often be posted on my social media or website. All material like videos or pictures taken in the making of a commision can be used and are the property of Josie De Rutte Art. By purchasing, you agree to the artist right to use these images. If for some privacy related reason you do not wish to have an image shared on social media please contact me at josiederutte.art@gmail.com
13. Copyright information:
Josie De Rutte Art retains the copyright for all commissioned artwork. Josie De Rutte Art also retains the copyright for any prints of commissioned artworks. No commissioned artworks may be reproduced, altered or copied without Josie De Rutte Art’s written permission. Josie De Rutte Art will never recreate or reproduce a clients personal commission for anyone else unless given permission by the client.Josie De Rutte Art reserves the right to share commissioned artworks for self promotional purposes on any of our social media platforms
The copyright for any of my non-commissioned artworks remain with Josie De Rutte Art and Josie De Rutte Art alone reserves the right to reproduce those images. Those who purchase any of my non-commissioned artwork either original or fine prints do not have any rights to reproduce the image unless Josie De Rutte Art also sells the copyright to them. Josie De Rutte Art reserves the right to use their artwork for promotional purposes online and in other promotional areas.
Josie De Rutte Art will solely retain the copyrights to any process videos and reels. Josie De Rutte Art retains the right to solely upload, distribute and monetise any material obtained by the making of the artwork.
14. Finally:
By ordering any of these products, you agree to be bound by these terms & conditions.
By placing an order, you warrant that you are at least 18 years old or have parents’ permission.
Payment fees are recognized before purchase.
All custom fees & taxes, if applicable at destination, are responsibility of the customer.
Commissions may be recorded, documented and posted on our website & social media sites.
